NEW YORK (1010 WINS) -- A gunman fatally shot a retired FDNY lieutenant after the two got into an argument outside the gunman’s upstate New York home, according to a report.

Stephen Swanton, 43, shot and killed former FDNY member Scott Kempler, 50, of Patterson, outside Swanton’s home in Herkimer County on Saturday, authorities told the New York Post

Swanton also shot a 55-year-old man from Oriskany, according to the outlet. That man wasn’t seriously injured.

The three men got into an argument at a house party that “spilled over” to Swanton’s nearby home, the outlet reported.

Swanton, who was arrested and charged with murder soon after the incident, is currently being held at the Herkimer County Jail. His attorney information wasn’t immediately available Wednesday.
