Staten Island man, 68, charged with murder after he shoots son, 34, in stomach

NEW YORK (1010 WINS) -- A 68-year-old man has been charged with murder after he shot his 34-year-old son in the the stomach Sunday afternoon on Staten Island.

Jospeh Smith was charged with second degree murder and criminal possession of a weapon, the NYPD said. The man's son's name was also Joseph Smith.

Prior to announcing the charges Sunday night, the NYPD initially said earlier in the day that at around 12:45 p.m., officers responded to a 911 call of a person shot inside a home on Beverley Road in the borough's Grasmere neighborhood.

"Upon arrival, police discovered a 34-year old male with a gunshot wound to the stomach," the NYPD said in a press release. "EMS responded and transported the victim to Staten Island University North hospital where he was pronounced deceased."

Prior to releasing the Smiths' names, police merely said a 68-year-old man, who was at the scene, was taken into custody without incident.

According to The Daily News, the elder Smith told police the shooting was an accident, and he thought the safety was on.

A firearm was recovered from the scene.
