Former Kaufman County Judge Eric Williams Appealing Murder Conviction

DALLAS (KRLD) - Testimony is underway in an appeals hearing over the conviction and death sentence for former Kaufman County judge Eric Williams.

He was found guilty of murdering Kaufman County District Attorney Mike McLelland and his wife in March of 2013. 

In his writ papers, Williams claims there was a secret deal between prosecutors and his ex-wife. Kim Williams testified that Eric Williams killed the McLellands and first assistant DA Mark Hasse. She drove the getaway car. During the testimony, Mrs. Williams was asked if she had a deal with prosecutors. "No, I do not." was her reply at the time. Prosecutors also deny there was a secret deal.

The defense also claims Williams' trial attorney, Maxwell Peck, was not effective. Peck was to be in court today but has been a no-show. One of Williams lawyers said Peck could not be found to serve with a subpoena and that he had not replied to e-mails. Since the Williams trial, Peck has been arrested for sexual assault of a child.
