McKinney City Councilman La'Shadion Shemwell is re-filing a voting rights lawsuit against the city which has put a recall election on the November ballot.
In January, Shemwell sued the city over the recall but dropped the suit in March out of concern about the Coronavirus outbreak. But now, the lawsuit is back on.
The city charter stipulates that all recall elections are city-wide. But Shemwell, argues he was elected only by the voters in his district and that only they should be allowed to remove him.
Shemwell tells NBC-5 his concern is that a city-wide vote will dilute the voice of the voters in his mostly minority district.
The recall was initiated by voters angered by Shemwell's call for the city to declare what he calls a "Black State of Emergency" because of police shootings of blacks.
