Orchard Park, NY (WBEN) - The Erie County Sheriff's Deputy who was caught on a police body camera roughing up a tailgater during an arrest before a Bills game in 2017 will face criminal charges.
Sheriff's Deputy Kenneth Achtyl is set to be arraigned Thursday afternoon. He was the officer seen on video arresting University at Buffalo Student Nicholas Belsito, who emerged from the incident badly bloodied.
“My Office is aware of the pending charges against Deputy Achtyl," read a statement from the Sheriff's Department. "He is on administrative leave, and when he is formally charged, his status will change to ‘suspended without pay’ until the conclusion of the court proceedings.”
Belsito's attorney, Aaron Glaser, was not immediately available for comment.
"I certainly have had private conversations with the sheriff," Erie County Executive Mark Poloncarz said. "It's always disappointing when you see a sheriff's deputy or any individual acting above the law. If he broke the law, he needs to be held responsible for it."
