NEW YORK (WCBS 880) — Police say a clerk at a smoke shop in Manhattan was punched in the face when an underage suspect got mad because he would not sell him a vaping device.

The incident happened at the Smoke and Vape Shop on Fourth Avenue on Friday, Sept. 13, in the East Village.

After punching the 36-year-old clerk, police say the suspect started breaking and throwing items on the counter before he took off.

New York State has instituted a ban on selling all flavored e-cigarette products. Sales of any tobacco product, including vaping devices, are prohibited to anyone under 21.

The flavor ban won't be officially enforced till October 4.
